Bad Credit Found On Background Checks Not Good For Jobseekers

According to a recent LA Times story, some of the 14 million unemployed jobseekers currently looking for work are caught in a vicious cycle of being behind on bills after losing a job and then having the bad credit created by the job loss spoil any chances of finding new employment. The story outlined cases of recruiters rescinding job offers after performing background checks and finding credit histories marred by overdue credit card payments, impending home foreclosures, or bankruptcy protection filings. A credit report review done during a background check has become a high hurdle for jobseekers to jump in a terrible job market.

To avoid future trouble, companies are using proactive background checks to gain insight into how jobseekers conduct their personal lives, since many believe that is how they will also conduct business. For these employers, examining credit reports during background checks helps them hire the best employees. Some staffing experts claim that money problems uncovered durnig background checks can be a sign of bad work habits in a jobseeker, while a good credit history means a worker is more likely to be trustworthy and reliable, two important traits for U.S. companies that lose billions – with a median loss of $150,000 – to employee theft annually.

Even if a background check shows a clean criminal record, many employers still aren't willing to take a chance on a jobseeker with bad credit. According to the Association of Certified Fraud Examiners, U.S. companies lose in average 5 percent of their annual revenue to employee fraud, 90 percent of which is from misappropriations like pilfering. The Society for Human Resource Management (SHRM) estimates that up to 50 percent of employers, including the U.S. government, run jobseeker credit checks. For example, applicants for security officer positions at the Transportation Security Administration (TSA) will be refused if a background check turns up more than $7,500 in past-due debt, delinquent taxes, or late child-support payments.

In most of the U.S., screening jobseekers with credit reports during background checks is legal as long as it is disclosed to applicants, who must give permission for a credit check to be run. Even with bad credit, most jobseekers agree to a background check since they believe any job offer would be lost if they refused. Most companies use reports produced for them by major credit bureaus. Federal law permits employers to see if jobseekers are paying their mortgages, credit cards, and bills on time, but does not allow them to see overall credit scores and they must notify candidates if they are rejected because of credit.

While no clear connection between credit history and job performance has been found yet, evidence exists that some information used by employers contains errors. In 2004, over one-third of companies surveyed by SHRM said they found inaccuracies in the credit histories they pulled on jobseekers. For that reason alone, jobseekers need to be aware what information will be contained in background checks performed on them, including criminal histories and credit reports. Since today’s bad job market can be even worse for those with bad credit, jobseekers are advised to run a “self background check” to see what information employers will see – before they see it – to help them find work.

Why would an employer hold a person's credit record against them? Most people do have bumps in the road, especially in today's economy, but to refuse to hire someone for it seems unjustified. This gives even more of a reason, though, for everyone to watch their credit reports. Thank you for providing a way for us to do so in a more efficient manner!!!

The damage that can be done from someone's identity being stolen goes far and wide. Now it can prevent someone from obtaining employment. And while in theory the victim could file a law suite against the thief, chances are they won't ever receive any financial compensation.

There are a few jobs where viewing credit records might be important... But a large majority of employers do not need a credit record to consider employment. It's a terrible thing to judge a perspective employee on but I can see the rare cases where it might be important.

Bad credit in general for anyone who wants to get loans or make a new mortgage payment, anything that has to do with money, even if job searching, can overall harm your financial status. I don't really finding it shocking. The government is changing about everything.

It's hard out there right now for a lot of people. Many have to take jobs that they normally wouldn't consider taking and those are some of the lucky ones. It's time to either go back to school or try to learn more skills.

Sounds like a dreadful cycle to be in, and one I imagine more and more people are falling into in these times. I'm surprised companies are allowed to look through personal finance records, wouldn't one solution be to make these private?

I left my job last july to move here and buy a grocery with my family. We were trying to assume a sba loan. After being told for 4-5 months by the bank that they were just waiting on the "red tape" and closing info...I called the sba myself, only to find out that even though the bank and the sba said they both talked week after week...NO WRITTEN APPLICATION WAS SUBMITTED. The bank says the sba lost it, BULL S***! Yes, we have a lawyer and have filed a lawsuit, he says we have a real good chance...but there bank is dragging it waaaaaay out. Bad news is...I have a wife and two little girls, I left a job with kraft foods, where i was a department coordinator for 10 years. I have tried to get a job since LAST july...over a year now, nobody will give me one. This mess took real good credit..and put me in the outhouse. The bank took our house(bad credit), I couldn't and still cannot pay credit card bills(bad)..I cannot pay electric or rent...i am on food stamps and cash assistance here in missouri...i am poorer than dirt, and quite honestly i am so depressed, i had a great job making $30k a year to my wifes(yes walmart gave her a job, not me though)..$12k a year. The bank not only killed the american dream...but ruined me as well. We were hoping for a settlement to fix everything...but the banks lawyers are dragging this way out...and i'm guessing even though i have a great work history...my terrible credit is to blame...scott.. long25@iland.net

also..i have seen by report, the bank took our house( that is charged off)...and i have 3 credit cards way over due for around $7k total...and no, i cannot pay anything on those...we are getting by week by week, month by month...and i apply at several places in person and online here by columbia missouri..i cannot believe we have made it over a year having not a penny...most would have took off, turned to violence robbing, or suicide...

thanks for this great post, it just goes to show the cycle that everyone gets into when they do not have money. our society is built like this and we cannot be mad, just make sure that you are on top of your game and keep good credit throughout your life.

I don't think that credit checks should matter when you are getting employed. If you don't have a job, and have missed some bills, how are you ever supposed to get another job?

As if things weren't bad enough for those out of work and looking for a job in the present economic climate. I think it's a little harsh for employers to be rejecting applicants based on their credit record because they can do as they like whilst there is so much competition for the jobs on offer.

Of course it is important to check personal financial history of the jobseeker. Who knows, maybe he has a bunch of loans on his head and changes his job one after another. In this time of economical downturn it would be no surprise if employers will find a lot of persons of such type.

I had a perfect credit score prior to getting ran down by an 18 year old that was still hung over from the night before. I was out of work for 6 months due to injuries from the accident. I made the mistake of getting a big name lawyer on TV that did not do anything to help me get a proper settlement those causing me to file bankruptcy to save my home. Now I am told that I am not a responsibly person because of it. I think this is just another excuse for this joke of a country to destroy more lives. This is so ridiculous! A credit report DOES NOT show a person true potential and it is discrimination to not hire someone because of a bad credit history!

This is one of the problems with the latest downturns in the economy and it provides a vicious cycle for those who are caught in the mess. I work as a Realtor and know just how difficult things have become for many people. It is hard for employers though to cut someone slack. It turns out to be a no win situation. Hopefully we are now seeing signs of the economy improving.

The worse part about this is that it's those who really need a job who often already have a bad credit report so it makes it even harder to dig out of debt and financial distress. There really should be an easier way to get a job without having to go through all that but it's another reason to start your own business I guess.

Most of you people JUST DON"T GET IT! When you comment that "this is why it makes sense to pay your bills on time to keep your credit great", you are totally ignoring the main issue. NO ONE, not even the self righteous ones with perfect credit who have posted here, CAN PAY BILLS ON TIME or AT ALL if they lose their job and source of income!!! Honest, bill paying people are losing income through NO FAULT OF THEIR OWN. How can you pay your bills when your main focus is survival - food first, then mortgage payments then medical emergencies come FIRST, before debts! I don't care what anyone says - no studies have PROVEN that poor credit history equals criminal behavior! There needs to be a law that protects people from this invasion of privacy. An employer is not loaning you money - he should not have access to your credit report. Criminal checks should be sufficient.

nice "POOR FAMILY" referance. I was a typical middle class family, who had faith in a bank for a dream...bank lied..went from middle class..BILLS PAID AND LITTLE DEBT...to not being able to pay bills. Am I considered white trash as well? In a tough economy,middle America,away from big cities, I have been in several "great interviews"...and employers are baseing my work on the fact I could pay 3 credit card bills? I just had to have a local agency pay my electric and propane...

I have heard about this one as well. I do know for a fact that a background check DOES include checking your credit score. However, HR generally has to approve a background check or deny a background check so there are some cases where you might get an offer prior to the company doing a background check. However, keeping your credit score is essential for so many other reasons as well that you should consider keeping your credit score high even if this is a myth.

I believe its a gross invasion of privacy for prospective employers to have access to your credit history. What right have they got to know this information and what the blue blazes are they going to do with it?
